By using this site, you ("the Client") have agreed to the Terms and Conditions ("Conditions") of use with Physiobench Ltd ("Physiobench") who provide their service ("the Service") on this website ("physiobench.com"). Please do not use this site if you do not agree to all of the Terms and Conditions of this agreement. We may revise the Terms and Conditions in the future.
By nature of the fact that the physios are not in direct contact with the Clients, the Service cannot meet the needs of every Client. Physiobench will endeavour to provide online treatment based on the information supplied in the assessment along with any supplementary questions requested by the physio. However if Physiobench feel they cannot provide a reasonable level of service, perhaps because the Clients' condition is too serious or inappropriate to be treated online, Physiobench will not proceed with the treatment & suggest that the Client take alternative courses of action.
Online physiotherapy treatment can never be as comprehensive as a face to face appointment with a Chartered Physiotherapist.
Provision of online treatment
We will only provide online treatment if the Client is 18 years or over. Once we have evaluated the assessment sent by the Client, we may decide we are unable to provide an acceptable treatment online, in which case we will give the Client a full explanation & refund.
Refunds Initiated by the Client
If for any reason your delivered service does not conform to the sale of goods act 1979 we will be happy to issue a credit or refund.
Refunds Initiated by Physiobench
If, after receiving the assessment & payment, Physiobench deem that they cannot provide a reasonable treatment to a Client, they will provide a full refund & explain the reasons.
We will endeavour to deliver, by email, personal treatment programmes to clients within 3 working days of the assessment being received, or, if applicable, within 3 working days of the subsequent questions raised by the physio being answered by the client. For the purpose of this agreement, working days exclude Saturdays, Sundays & UK Public holidays. As part of the treatment programme, Physiobench will send the Client periodic prompts to the Clients email address.
Dealings with advertisers & merchants
Physiobench.com may contain advertisements for other sites and companies. Unless stated we do not endorse any product linked to or advertised on physiobench.com. Physiobench make no assurances or warranties (expressed or implied) about the accuracy, completeness or reliability of any advertisement links to and from other sites.
Links to / from other sites
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Physiobench has no control over such sites and resources, you acknowledge and agree that Physiobench is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.
To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from Physiobenchs negligence, Physiobench hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Service, and any information, content, advertisements or products provided or distributed through the Service including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to Physiobench. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. If you are a consumer your statutory rights, if any, are not affected.
By using the Service you agree to defend, indemnify and hold Physiobench, its officers, partners, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Content in a manner that violates or is alleged to violate these
These Conditions constitute the entire agreement between you and Physiobench and govern your use of the Service, superseding any prior agreements between you and Physiobench. The Conditions and the relationship between you and Physiobench shall be governed by the laws of England. You and Physiobench agree to submit to the exclusive jurisdiction of the English courts. Any failure by Physiobench to exercise or enforce any right or provision of the Conditions shall not constitute a waiver of such right or provision. If any provision of the Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Conditions remain in full force and effect.
